Helping injured people recover money damages can be very rewarding. It is not an easy job nor is it an easy process.  Insurance companies do not write checks easily. Over the past 20 years—first working for other law firms and then opening my own firm in 2007—I have represented well over 500 auto and truck accident clients with damages ranging from soft tissue to death. Truck and auto wreck injury claims, settlements, and judgments have ranged from $2,000 to over $300,000.  When it comes to serious on-the-job injury claims or premises liability negligence cases, settlements have been anywhere from $50,000 over $3,000,000.

Each and every auto, truck, or other types of accident case is different, and each person’s injuries and damages are unique. Depending on related medical expenses and costs, each person’s net results will be different as well.

My law firm’s contingency fees range from 33 to 40% depending on the stage of the case and litigation.  I have personally written checks to clients —after attorney's fees, costs, and related medical expenses—ranging from $1,000 to over $300,000.

Workplace Injury

A 34-year-old male quality inspection engineer was going about his every day work responsibilities when he was involved in a major oil refinery explosion that made national news. During litigation, it was found that the plant where he worked was severely negligent in its maintenance and safety measures. In this massive explosion, this worker was blown backwards, sustaining severe neck and back injuries, hearing loss, and severe emotional stress. He watched several co-workers die and some who got burned. My law firm co-counseled with a firm in Corpus Christi to obtain a settlement of over $1,900,000. After attorney's fees, case costs, and related medical bills, the client received approximately $1,100,000.

Workplace Injury

A 33-year-old male oil refinery quality control inspector and engineer was involved in a major oil refinery explosion in Galveston County. During litigation, it was found that the plant where he worked was severely negligent in its maintenance and safety measures. This worker suffered from TMJ, hearing loss, and other physical damages. My law firm co-counseled with a firm in Corpus Christi to obtain a settlement of over $1,000,000. After attorney's fees, case costs, and related medical bills, the client received approximately $600,000.

Defective Ranch Vehicle Injury

My client was riding on a 4-wheeler ranch vehicle at a privately owned ranch with some friends in South Texas. This particular outdoor ranch vehicle appeared to be stable and secure for passengers at two levels. For some reason, the upper seat failed to hold three passengers, and all three riders fell backwards. Our client fell and fractured her spine and was bitten by many fire ants. She was taken by ambulance to the local hospital. This hard-working Texan lost time from her work and had a long, painful recovery.  This was another case where my law firm co-counseled with another firm to prove that the product was designed incorrectly and was inherently dangerous. A lawsuit was filed against the ranch owner, the manufacturer of the vehicle, and the dealership where the vehicle was purchased.  After attorney's fees, case costs, and related medical bills, the client received approximately $130,000.

Car Accident Claim

A 62-year-old female was severely injured during a car accident where she was struck from behind by a reckless driver on the highway. The client sustained substantial knee and shoulder injuries. This client was already somewhat disabled, but she needed knee and shoulder surgery as a result of this wreck.  This was a very complicated medical case where the client suffered from many previous medical injuries and conditions, so the insurance carriers were not easy to negotiate with. It took approximately three years to complete, but we were able to obtain three recoveries:  1) The $50,000 from the responsible third party’s insurance company (which was the maximum liability policy);  2) $24,000 in related PIP funds which were part of the client’s own PIP policy; and 3) $70,000 in an underinsured claim against the client’s own underinsured policy. After attorney's fees, costs, and related medical expenses, this client received compensation of approximately $77,000.

Car Accident Claim

A 62-year-old  male was severely injured during an auto wreck where he was struck from behind by a distracted driver. The client sustained substantial neck and back trauma, and a herniated disk.  This client was already somewhat disabled, but he needed neck surgery. We were able to obtain the automobile insurance policy limits of $100,000 from the negligent driver's insurance policy. After attorney fees, costs and related medical expenses, this client received compensation at approximately $66,000.

Workplace Injury

A 40-year-old male sanitation worker was injured on the job and then terminated. This was a hybrid of a personal injury claim and a wrongful termination claim. This client suffered severe injuries to his back and severe damage to his credit due to loss of income. My client received a substantial monetary settlement for wrongful termination. This settlement paid for the client's related medical expenses and pain and suffering. After attorney's fees, case costs, and related medical bills, the client received approximately $50,000.

Hotel Shuttle Bus Injury

This was a rather bizarre case of a 50-year-old woman who was visiting Texas for a relative's graduation. She was picked up at the airport by a local hotel using its own airport shuttle bus. For some reason, the hotel sent their older shuttle bus where the doors to the bus were not in proper working order. While the bus was entering the highway, the client stood up to grab her jacket. At the same time, the bus turned, and she flew out the doors of the moving shuttle bus. The client rolled onto the pavement and incurred severe road rash and cuts and bruises. She miraculously survived and sought follow-up treatment for months. After nearly four years of arguing with the insurance carrier and numerous defendants—who claimed they had no money or insurance policies—we settled the claim at mediation for $100,000. After attorney's fees, case costs, and related medical bills, the bus accident client received approximately $49,000.

Workplace Injury

A 38-year-old male oil rig driver fell off an unsafe and unsecured catwalk which resulted in a back injury. This was a non-subscriber claim, which means that the client's employer did not have Workers Compensation Insurance. After attorney's fees, case costs, and related medical bills, the client received approximately $40,000.

Workplace Injury

A 73-year-old female laundry worker in a hospital got her arm caught in a press machine, which resulted in a torn rotator cuff. This woman was a hard-working citizen who was placed in a job where she was to use a dangerous and out-of-date laundry press machine. She was the sole breadwinner of her family, and this job was crucial to her family's survival. This was a non-subscriber claim, which means that the client's employer did not have Workers Compensation Insurance. The total monetary settlement was over $90,000. After attorney's fees, case costs, and related medical bills, the client received approximately $50,000 for her workplace injuries.

Auto and Bus Injury

A 41-year-old male was a passenger on a METRO bus that collided with a METRO police car. The client sustained severe knee damage resulting in knee surgery. After two years of litigation and finally reaching a bench trial, a judgment was rendered in Harris County District Court and the client was awarded an amount of $64,000 plus interest. After attorney's fees, costs and related medical expenses, the client received compensation of approximately $32,000. It is important to note that damages are statutorily capped at $100,000 when METRO is a defendant.

A 64-year-old female school bus driver was injured during an auto wreck where she was slammed in the rear of her bus by two speeding cars. The client sustained neck and back trauma, and a herniated disk. We were able to obtain two automobile insurance policy limits in excess of $30,000 each. A 23-year-old female personal trainer and nutritionist was involved in an auto wreck and hit head-on by a car running a stop sign. She sustained two cracked, broken front teeth among other physical damages suffered. We were able to obtain $50,000 (policy limits). A 27-year-old woman bit into a piece of metal cookware that fell into her pasta at a well-known Galleria-area restaurant. This resulted in two cracked molars. This client received substantial monetary compensation after dental and medical bills, attorney fees and expenses were paid.

Defective Products

A 43-year-old woman used a home exercise band that destroyed her eyeball and eyesight. This was a very complicated defective products case against a major US retailer, a Chinese manufacturer, a US distributor and a designer. The recalled exercise stretch band snapped back and hit the client in the eye. This was a case where my law firm co-counseled with another firm to prove that the product was designed incorrectly and was inherently dangerous. Like many defective and recalled products, this item was sold to consumers throughout the country. The client’s injuries resulted in loss of vision to the eye and physical scarring in the eyeball along with other physical and emotional damages suffered. My firm co-counseled with another firm to obtain a confidential product liability settlement after nearly two years of litigation, expert reports, and international depositions.

Defective Products

A 13-year-old male received life-threatening injuries from a defective door design from a major car wreck (crushed car). The lawsuit helped prove damages in defective auto design against a major auto manufacturer. The client sustained major facial scars and had to endure numerous operations and an extended hospital stay. I co-counseled with another firm to obtain a confidential settlement against a major U.S. auto manufacturer after nearly two years of litigation, expert reports, and depositions.

Additionally, my law firm was able to secure two policy limit policies from two auto insurance carriers—a third party claim as well as an underinsured claim.

Hot Water Scald Burn Injury

An 18-month-old suffered life-altering hot water scald burn injuries from a hot water heater set above a safe temperature setting at the apartment complex where this little baby lived. The child sustained severe second-and third-degree burns injuries to both legs and feet. The injured baby received several surgeries including skin grafts and skin stretching as part of her recovery. After two years of litigation, seven retained experts, and multiple depositions, the family received monetary compensation to pay for past and future medical expenses in the form of a substantial lifetime annuity purchased for the child and her future care. This confidential annuity plan was approved by an independent Guardian Ad Litem and the District Court Judge.

Daycare Injury

A 2-year-old suffered a broken wrist at daycare with no explanation given to parents or police. The child suffered a fractured arm and needed one corrective surgery. Because the daycare could not provide any explanation, the parents sought our legal counsel. It was clear that the daycare center was negligent in some form. The family received monetary compensation to pay for past and future medical expenses, and pain and suffering. An annuity was purchased for the child for her future. This confidential annuity plan was approved by an independent Guardian Ad Litem and the district court judge.
